These Terms & Conditions (“Terms”) govern your use of elevateearlyed.com and the training, consulting, educational, and related services provided by Elevate Early Ed, LLC (“Elevate Early Ed,” “we,” “us,” or “our”).

By accessing our website, purchasing a service, registering for training, or using our services, you agree to these Terms. If you do not agree, please do not use the website or services.

SERVICES

Elevate Early Ed provides professional development, training, consulting, program support, educational resources, and related services for early childhood professionals and programs.

Descriptions, dates, times, formats, prices, availability, instructors, and requirements may vary by service. We may update service information when reasonably necessary.

PURCHASES AND PAYMENT

Purchases made through our website are processed through Squarespace Commerce and its connected payment processor, Stripe.

You agree to provide accurate and complete purchaser, billing, and contact information. Prices are displayed in U.S. dollars unless otherwise stated.

An order is not considered complete until payment has been successfully processed or another payment arrangement has been approved by Elevate Early Ed.

TRAINING SEATS AND PARTICIPANT REGISTRATION

A purchaser may purchase one or more training seats. When attendee information is not supplied during checkout, the purchaser may receive a registration link to provide the information required for each participant.

The purchaser is responsible for:

• Providing accurate purchaser and participant information
• Sending registration links only to the intended participants
• Ensuring that all seats are assigned before applicable deadlines
• Confirming that participants receive class instructions and communications
• Contacting Elevate Early Ed promptly if purchaser or participant information is incorrect

Registration links and related access credentials should not be published, posted publicly, or shared with individuals who are not authorized to use the purchased seats.

TRAINING REQUIREMENTS

Participants are responsible for reviewing and satisfying all stated course requirements. Depending on the class, requirements may include:

• Timely registration
• Attendance for the required duration
• Identity verification
• Completion of a pre-test, post-test, evaluation, or other required activity
• Achieving a required passing score
• Participating from an appropriate device or location
• Following instructor directions and professional conduct expectations

Purchasing a training seat does not by itself guarantee course completion, credit, certification, or a certificate.

ATTENDANCE AND COMPLETION

Participants must attend and participate according to the requirements communicated for the applicable course.

Late arrival, early departure, failure to participate, failure to complete required activities, technical problems under the participant’s control, or inaccurate registration information may affect eligibility for course credit or certification.

Certificates are issued only after all applicable attendance, participation, assessment, evaluation, payment, and documentation requirements have been satisfied.

CERTIFICATES AND RECORDS

Participants and purchasers are responsible for reviewing names, email addresses, and other registration details for accuracy.

Elevate Early Ed may correct administrative or typographical errors when adequate documentation is provided. Requests involving substantive changes, replacement certificates, or records submitted to a third party may require additional review.

Certificates confirm completion of the requirements recorded by Elevate Early Ed. They do not guarantee employment, licensure, regulatory approval, or acceptance by a particular employer, agency, or organization.

CANCELLATIONS, TRANSFERS, AND REFUNDS

Cancellation, transfer, rescheduling, credit, and refund eligibility may depend on the service purchased, the timing of the request, costs already incurred, and any policy displayed during checkout or communicated for the applicable service.

To request assistance, contact training@elevateearlyed.com as soon as possible and include the purchaser’s name, order information, and class or service involved.

Submitting a request does not guarantee that a refund, transfer, credit, or rescheduling request will be approved. Nothing in these Terms limits any rights that cannot legally be waived.

CLASS OR SERVICE CHANGES

Elevate Early Ed may reschedule, modify, substitute an instructor for, or cancel a class or service because of enrollment, instructor availability, technical problems, emergencies, severe weather, regulatory changes, or other circumstances.

When Elevate Early Ed cancels a paid service and cannot provide a reasonable replacement, we may offer a transfer, credit, or refund as appropriate.

VIRTUAL TRAINING AND TECHNOLOGY

Virtual services may use Zoom or another third-party platform. Participants are responsible for having compatible equipment, a reliable internet connection, functioning audio when required, and access to the email address used for registration.

We are not responsible for outages, connection failures, device problems, blocked emails, spam filtering, or other technical issues outside our reasonable control. We will make reasonable efforts to assist when notified promptly.

ACCEPTABLE CONDUCT

You may not:

• Use the website or services for unlawful, fraudulent, abusive, or disruptive purposes
• Interfere with website security or operation
• Attempt to access another person’s account, order, registration, or records
• Copy, distribute, sell, publish, or commercially exploit protected course materials without written permission
• Record a class or participant without authorization
• Misrepresent attendance, identity, completion, assessment results, or eligibility for a certificate
• Share private registration links publicly or with unauthorized individuals

We may restrict access or remove a participant when reasonably necessary to protect participants, instructors, systems, records, intellectual property, or the integrity of a training.

INTELLECTUAL PROPERTY

The website and its original content—including training materials, presentations, graphics, documents, assessments, branding, text, videos, and other resources—are owned by or licensed to Elevate Early Ed and are protected by applicable intellectual-property laws.

Purchasing or attending a service gives you a limited, personal, nonexclusive, nontransferable right to use the provided materials for their intended educational purpose. It does not transfer ownership or grant permission to reproduce, resell, publish, distribute, or create commercial derivative works unless we provide written authorization.

THIRD-PARTY SERVICES

Our website and services may use or link to third-party services, including Squarespace, Stripe, Vercel, Supabase, Resend, Zoom, and other providers.

Your use of a third-party service may also be governed by that provider’s terms and privacy policy. We are not responsible for third-party services, outages, content, security practices, or policy changes outside our control.

DISCLAIMERS

We make reasonable efforts to provide accurate and useful educational and consulting services. However, laws, regulations, licensing standards, agency interpretations, and professional requirements may change.

Unless expressly agreed in writing, our services do not constitute legal, tax, medical, accounting, or regulatory advice. You remain responsible for confirming the requirements that apply to your program, employment, license, facility, or situation.

We do not guarantee a particular business result, licensing outcome, accreditation decision, star rating, enrollment result, employment result, regulatory approval, or financial outcome.

LIMITATION OF LIABILITY

To the fullest extent permitted by law, Elevate Early Ed will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from the website or services.

To the fullest extent permitted by law, Elevate Early Ed’s total liability for a claim related to a purchased service will not exceed the amount paid to Elevate Early Ed for the specific service giving rise to the claim.

Some jurisdictions do not allow certain exclusions or limitations, so parts of this section may not apply to you.

INDEMNIFICATION

To the extent permitted by law, you agree to indemnify and hold harmless Elevate Early Ed, LLC and its owners, employees, contractors, and representatives from claims, damages, liabilities, and reasonable expenses arising from your unlawful misuse of the website or services, your violation of these Terms, or your infringement of another person’s rights.

GOVERNING LAW

These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law principles.

Any dispute will be handled in a court with appropriate jurisdiction in North Carolina unless applicable law requires otherwise.

Your continued use of the website or services after updated Terms are posted constitutes acceptance of the revised Terms to the extent permitted by law.

SEVERABILITY

If any part of these Terms is found unenforceable, the remaining provisions will continue in effect.

ENTIRE AGREEMENT

These Terms, the Privacy Policy, applicable checkout information, and any written service agreement between you and Elevate Early Ed constitute the agreement governing the applicable website use or service.
